The first day we got there about 9 o’clock and was cleaning up things and shut out the water. The next day we were working on the dam. I was up on the top and got the block and tackle, and tried to get up the middle post on the dam, and I heard two or three shots fired. I didn’t take any notice of it, I thought it was some boys or hunters firing at squirrels or something. They fired four or five more as fast as they could and I looked around. I could not see anybody. Dave Keplinger was working down below he called up to Mr. Thompson he said they fired a bullet down into the dam. Mr. Thompson says, “Oh no, I don’t believe that!” He says “yes, they made dirt fly around.” We went down and found a place where the bullet struck and glanced off. In all they fired between ten and fifteen shots. That was all for that time.

Afterwards I was working down below and heard some heavy words and went up. I saw a strange man there, a big man. After he went away I asked who he was and they told me it was Mr. Eastham. Mr. Thompson told him if he think [sic] the Blackwater Company had no right to use the dam why didn’t he take it by the law. He told Mr. Thompson he could fight him and any two men he had there. Mr. Thompson told him that he didn’t have to do that. Let the law settle it would be the best way.
